ClypThese Terms of Service ("Terms") govern your access to and use of Clyp, operated by Monarch Labs ("we," "us," or "our"), including our iOS application, website, and related services (the "Service"). By creating an account or using Clyp, you agree to these Terms and our Privacy Policy.
1. The Clyp marketplace
Clyp is a technology platform that connects clients seeking grooming services with independent barbers who provide house-call services. Barbers are independent contractors, not employees of Monarch Labs. We do not perform haircuts and are not a party to the service agreement between you and your barber, except as payment facilitator where applicable.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use Clyp. Barbers must maintain valid licenses where required by law and provide accurate credentials. You are responsible for keeping your account credentials secure.
3. Accounts and roles
Clients may discover barbers, request bookings, pay through the app, and leave reviews. Barbers may set availability, accept jobs, travel to client locations, and receive payouts through Stripe Connect. Barbers also agree to the separate Master Artisan EULA. You may not misrepresent your identity, role, or qualifications.
4. Bookings, cancellations, and refunds
Booking terms, pricing, surge fees, cancellation windows, and refund eligibility are displayed in the app and may vary by market. Clients and barbers must honor confirmed appointments and communicate through in-app channels when possible. No-shows, late cancellations, and disputes may result in fees, account restrictions, or credits as described in-app.
5. Payments
Payments are processed by Stripe. By paying through Clyp, you authorize us and our payment partners to charge your selected payment method. Barbers receive payouts subject to Stripe verification, platform fees, chargebacks, and compliance holds. Apple Pay and other methods are subject to their own terms.
6. Acceptable use
You agree not to:
- Violate laws, third-party rights, or professional licensing requirements
- Harass, threaten, or discriminate against other users
- Share off-platform payment details or attempt to circumvent Clyp fees
- Upload false, misleading, or infringing content
- Interfere with the Service, scrape data, or reverse engineer the app
- Use the Service for unauthorized commercial purposes
We may remove content, suspend accounts, or report activity to authorities when we believe these Terms or applicable law have been violated.
7. User content and Style Vault
You retain ownership of photos, reviews, and other content you submit. You grant Clyp a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content to operate the Service (including marketing where permitted). You represent that you have rights to content you upload.
8. Safety and house calls
House-call services occur at locations you provide. You are responsible for providing a safe, appropriate workspace and complying with building rules. Clyp does not guarantee barber arrival times, outcomes, or suitability of any particular barber. Use reasonable judgment and report safety concerns immediately.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONARCH LABS AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY INTERACTION WITH ANOTHER USER. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to indemnify and hold harmless Monarch Labs from claims arising out of your use of the Service, your content, your interactions with other users, or your violation of these Terms.
12. Dispute resolution
Before filing a claim, contact support@theclyp.com so we can try to resolve the issue informally. Unless prohibited by law, disputes will be resolved through binding arbitration on an individual basis, and you waive class actions. You may opt out of arbitration within 30 days of account creation by emailing us with subject line "Arbitration Opt-Out."
13. App Store terms
If you downloaded Clyp from the Apple App Store, Apple is not a party to these Terms and has no obligation to furnish maintenance or support. Apple may refund purchases according to its policies. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of the App Store-related provisions.
14. Changes and termination
We may modify the Service or these Terms at any time. Continued use after changes constitutes acceptance. We may suspend or terminate accounts that violate these Terms or pose risk to the community.
15. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where mandatory consumer protections in your jurisdiction apply.
